Article 1 – Definitions
In these terms and conditions, the following definitions apply:
- Supplementary Agreement: An agreement whereby the consumer acquires products, digital content, and/or services in connection with a distance contract, and these items or services are supplied by People & Media Network or by a third party based on an agreement between that third party and People & Media Network.
- Reflection Period: The period within which the consumer can exercise their right of withdrawal.
- Consumer: The natural person who is not acting for purposes relating to their trade, business, craft, or professional activity.
- Day: Calendar day.
- Digital Content: Data produced and supplied in digital form, including but not limited to online courses, podcasts, video content, music, digital books, newsletters, prompts, and other downloadable or streamable media offered through the People & Media platform.
- Continuing Agreement: An agreement that provides for the regular delivery of goods, services, and/or digital content during a specified period.
- Durable Data Carrier: Any means – including email – that enables the consumer or People & Media Network to store information in a way that facilitates future consultation and allows for unchanged reproduction of the stored information.
- Right of Withdrawal: The consumer’s option to withdraw from the distance contract within the reflection period.
- People & Media Network (or “we”, “our”, “us”): People & Media B.V., the legal person offering products, digital content, and/or services to consumers at a distance.
- Platform: The website www.peopleandmedia.com, including all subdomains, mobile applications, and associated digital properties operated by People & Media B.V.
- User Account: A personal account created by the consumer on the Platform for accessing services and managing subscriptions.
- Event: Any live or virtual gathering, workshop, masterclass, or seminar organized or facilitated by People & Media Network.
- Distance Contract: An agreement concluded between People & Media Network and the consumer under an organized system for distance sales, where exclusive use is made of one or more means of distance communication.
- Model Withdrawal Form: The European standard withdrawal form included in Article 6.
- Distance Communication Technology: Means that can be used for concluding an agreement without the consumer and business operator having to meet simultaneously in the same space.

Article 3 – Applicability
- These general terms and conditions apply to every offer from People & Media Network and to every distance contract concluded between the business operator and consumer.
- Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, People & Media Network will indicate how the general terms and conditions can be viewed and that they will be sent free of charge at the consumer’s request.
- If the distance contract is concluded electronically, the text of these general terms and conditions may be made available to the consumer electronically in such a way that the consumer can easily store them on a durable data carrier.
- In cases where specific product or service conditions apply in addition to these general terms and conditions, the consumer may always invoke the applicable provision that is most favorable to them in the event of conflicting conditions.
Article 4 – The Offer
- If an offer has a limited validity period or is made subject to conditions, this will be explicitly stated in the offer.
- The offer contains a complete and accurate description of the offered products, digital content, and/or services, sufficiently detailed to allow the consumer to make a proper assessment.
- Each offer contains sufficient information to make clear to the consumer what rights and obligations are attached to accepting the offer.
Article 5 – The Agreement
- Subject to the provisions in paragraph 4, the agreement becomes valid when the consumer accepts the offer and meets the corresponding conditions.
- If the consumer has accepted the offer electronically, People & Media Network will immediately confirm receipt. Until receipt of this acceptance has been confirmed, the consumer may dissolve the agreement.
- If the agreement is created electronically, People & Media Network will take appropriate technical and organizational measures to secure the electronic transfer of data and ensure a safe web environment.
- Within legal frameworks, People & Media Network may inquire about the consumer’s ability to fulfill their payment obligations. If People & Media Network has good grounds to not enter into the agreement, they are entitled to refuse an order with reasons or to attach special conditions.
- People & Media Network will provide the consumer with the following information no later than the delivery of the product, service, or digital content:
- The visiting address where the consumer can lodge complaints
- The conditions and manner of exercising the right of withdrawal
- Information about warranties and after-sales service
- The price including all taxes, delivery costs, and payment method
- Requirements for terminating the agreement if it has a duration of more than one year
- The model withdrawal form when the consumer has a right of withdrawal
Article 6 – Right of Withdrawal
- The consumer may dissolve an agreement regarding the purchase of a product during a reflection period of at least 14 days without giving reasons.
- The reflection period begins on the day after the consumer has received the product, or:
- If multiple products were ordered: the day the last product was received
- If delivery consists of multiple shipments: the day the final shipment was received
- For regular delivery agreements: the day the first product was received
- For services and digital content not on a material carrier: the day following conclusion of the agreement
Article 7 – Consumer Obligations During the Reflection Period
- During the reflection period, the consumer will handle the product and packaging with care, only unpacking or using it to the extent necessary to determine its nature, characteristics, and functioning.
- The consumer is only liable for value depreciation resulting from handling beyond what is permitted in paragraph 1.
- The consumer is not liable for value depreciation if People & Media Network has not provided all legally required information about the right of withdrawal.
Article 8 – Exercise of the Right of Withdrawal
- If the consumer exercises their right of withdrawal, they must notify People & Media Network within the reflection period using the model withdrawal form or in another unambiguous way.
- The consumer must return the product within 14 days following the notification in paragraph 1, unless People & Media Network has offered to collect the product.
- The consumer returns the product with all delivered accessories, if reasonably possible in original condition and packaging.
- The risk and burden of proof for the correct and timely exercise of the right of withdrawal lies with the consumer.
- The consumer bears the direct costs of returning the product.
- If the consumer exercises their right of withdrawal, all supplementary agreements are dissolved by operation of law.
Article 9 – Obligations of People & Media Network Upon Withdrawal
- If People & Media Network enables electronic withdrawal notification, they will send an acknowledgment of receipt immediately.
- People & Media Network will reimburse all payments from the consumer, excluding any delivery costs for the returned product, within 14 days following the withdrawal notification.
- People & Media Network will use the same payment method the consumer used for reimbursement, unless the consumer agrees to a different method. The reimbursement is free of charge.
Article 10 – Exclusion of Right of Withdrawal
People & Media Network can exclude the following from the right of withdrawal, provided this was clearly stated in the offer:
- Products or services whose price is subject to financial market fluctuations beyond People & Media Network’s control.
- Agreements concluded during a public auction.
- Service agreements after complete execution, provided the execution began with the consumer’s express prior consent and the consumer acknowledged losing their right of withdrawal.
- Digital content supplied on a non-tangible medium, if performance has begun with the consumer’s express prior consent and the consumer has acknowledged losing their right of withdrawal.
Article 11 – Pricing
- During the validity period of the offer, prices will not be increased, except for changes due to VAT rate adjustments.
- People & Media Network can offer products or services at variable prices when subject to financial market fluctuations beyond its control.
- Price increases within 3 months after conclusion of the agreement are only allowed if they result from statutory regulations.
- Price increases from 3 months after conclusion are only allowed if stipulated by People & Media Network and: (a) they result from statutory regulations, or (b) the consumer may terminate the agreement from the day the price increase takes effect.
- All prices include VAT.
Article 12 – Performance and Additional Warranty
- People & Media Network guarantees that products and/or services comply with the agreement, stated specifications, reasonable requirements of reliability/usability, and existing statutory provisions.
- An additional guarantee never limits the consumer’s legal rights and claims under the agreement.
- Additional guarantee means any commitment granting the consumer rights or claims beyond what is legally required.
Article 13 – Delivery and Execution
- People & Media Network will take the greatest possible care when receiving and implementing orders.
- The place of delivery is the address the consumer has provided.
- Accepted orders will be executed within 30 days, unless a different delivery period has been agreed. If delivery is delayed or cannot be fulfilled, the consumer will be notified within 30 days and may dissolve the agreement at no cost.
- After dissolution, People & Media Network will immediately repay the amount the consumer has paid.
- The risk of damage and/or loss of products rests with People & Media Network until delivery, unless explicitly agreed otherwise.
Article 14 – Subscription Transactions
- Subscription transactions include annual and monthly subscriptions to People & Media services.
- Monthly membership begins with a free 30-day trial period for new members. Monthly fees are charged at the end of the trial period unless canceled before it ends.
- Monthly membership automatically continues each month until canceled. If a payment fails, People & Media Network may deny access until valid payment is received. The consumer remains responsible for any uncollected amount.
- Monthly membership can be canceled up to 15 days before the billing date. After cancellation, access continues until the end of the current billing period.
- Annual membership fees are charged immediately. A 14-day withdrawal period applies. Physical gifts must be returned per Articles 7 and 8. After 14 days, cancellation or refund is not possible.
Article 15 – Payment
- Unless otherwise specified, amounts owed must be paid within 14 days after the start of the reflection period, or within 14 days after conclusion of the agreement.
- Payment is processed through one or more third-party payment service providers as indicated during checkout. Available payment methods may vary. People & Media Network reserves the right to change payment service providers at any time.
- For products sold with advance payment, no rights regarding execution may be asserted before payment has been made.
- The consumer must report inaccuracies in payment details to People & Media Network without delay.
- If the consumer fails to pay in a timely manner, after being informed and granted 14 additional days, statutory interest will be owed and People & Media Network may charge extrajudicial collection costs.
Article 16 – Complaints Procedure
- People & Media Network has a publicized complaints procedure and handles complaints accordingly.
- Complaints must be submitted within a reasonable time after discovery, complete and clearly described.
- Complaints will be answered within 14 days. If longer processing is needed, a notice of receipt with a timeline will be sent within 14 days.
- The consumer should give at least 4 weeks to resolve the complaint in mutual consultation. After this period, the dispute resolution procedure applies.
Article 17 – Disputes
- These terms and conditions are exclusively governed by Dutch law.
- Any disputes shall be submitted to the competent court in Amsterdam, the Netherlands, unless mandatory law requires otherwise.
- For EU consumers, the European Online Dispute Resolution platform is available at https://ec.europa.eu/consumers/odr. People & Media Network is not obligated to participate in alternative dispute resolution proceedings before a consumer arbitration body.
Article 18 – Privacy and Data Protection
1. Data Collection and Use
- People & Media Network collects and processes personal data in accordance with the General Data Protection Regulation (GDPR) and applicable data protection laws.
- We collect only data necessary for the performance of our services and legitimate business purposes.
- Personal data may include: name, address, contact details; payment information; usage data and preferences; communication history; technical data (IP address, device information).
2. Data Protection Principles
- We process personal data lawfully, fairly, and transparently.
- Data is collected for specified, explicit, and legitimate purposes.
- Processing is limited to what is necessary.
- We maintain accurate and up-to-date data.
- Data is kept for no longer than necessary.
- Appropriate technical and organizational security measures are in place.
3. Legal Basis for Processing
- Performance of a contract to which the consumer is a party.
- Compliance with a legal obligation.
- Legitimate interests, provided these do not override the consumer’s fundamental rights.
- Consent of the consumer, where applicable.
4. Rights of the Consumer
Under the GDPR, the consumer has the following rights:
- Right of access: to request a copy of personal data held.
- Right to rectification: to request correction of inaccurate data.
- Right to erasure (“right to be forgotten”): to request deletion under certain conditions.
- Right to restriction of processing.
- Right to data portability: to receive data in a structured, commonly used format.
- Right to object to processing, including profiling and direct marketing.
- Right to withdraw consent at any time.
5. Data Retention
Personal data will be retained only as long as necessary to fulfill the purposes for which it was collected, or as required by law. Data will then be securely deleted or anonymized.
6. Third-Party Sharing
People & Media Network may share personal data with third-party service providers solely for delivering services. We ensure appropriate contractual safeguards are in place. Personal data will not be sold to third parties.
7. Privacy Policy
Full details are set out in our Privacy Policy, available on the Platform. The Privacy Policy forms an integral part of these terms and conditions.
Article 19 – User Accounts
- The Platform is intended for consumers aged 16 and over. By creating a User Account, the consumer confirms they are at least 16 years of age. Consumers under 16 may only use the Platform with verifiable consent from a parent or legal guardian, in accordance with the GDPR and Dutch implementation law (UAVG).
- To access certain services, the consumer must create a User Account with accurate and complete registration information.
- The consumer is solely responsible for maintaining the confidentiality of their login credentials and for all activities under their account. Unauthorized use must be reported immediately.
- People & Media Network reserves the right to suspend or terminate a User Account if the consumer: (a) violates these terms, (b) provides false information, (c) engages in fraudulent or unlawful activity, or (d) acts harmfully toward other users or third parties.
- Upon termination, the consumer’s right to access paid services ceases. Prepaid amounts for unused subscription periods will be handled per Articles 6–9 and Article 14.
- The consumer may request account deletion at any time by contacting admin@peopleandmedia.com. Deletion does not automatically entitle the consumer to a refund.
Article 20 – Digital Content and Services
- People & Media Network offers digital content including online courses, podcasts, video, music, digital books, newsletters, speaker profiles, and AI-generated prompts.
- Access to digital content is granted through a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use only. Reproduction, distribution, modification, or creation of derivative works is prohibited without prior written consent.
- Unless explicitly stated otherwise, digital content is provided for streaming or online access only. Downloading is permitted only where expressly indicated.
- People & Media Network may modify, update, or remove digital content at any time. If removal materially affects an active paid subscription, reasonable efforts will be made to notify the consumer and provide a comparable alternative.
- People & Media Network does not guarantee uninterrupted or error-free access. Temporary disruptions may occur due to maintenance, updates, or circumstances beyond our control.
- Where content is provided by third-party speakers or creators, People & Media Network acts as a facilitator. Views expressed are those of the respective creators.
- The Platform may contain links to products sold through third-party retailers (including but not limited to Amazon, Bol.com, and other external webshops). Purchases made through such links are governed by the terms and conditions of the respective third-party retailer. People & Media Network is not a party to such transactions and assumes no liability for the products, delivery, returns, or customer service provided by third parties. Where applicable, People & Media Network may receive a commission or referral fee for such purchases (affiliate links), which does not affect the price paid by the consumer.
Article 21 – Events
- People & Media Network may organize live and virtual events, including masterclasses, workshops, seminars, and networking gatherings.
- Registration for an event constitutes acceptance of these terms and any specific event terms communicated at the time of registration.
- Consumer cancellation: Up to 14 days before the event for a full refund. Between 14 and 7 days before: 50% refund. Less than 7 days before: no refund. The consumer may transfer their registration to another person at no charge.
- Cancellation or rescheduling by People & Media Network: We reserve the right to cancel or reschedule due to insufficient registration, force majeure, or other circumstances. The consumer will receive a full refund or the option to attend a rescheduled event.
- People & Media Network assumes no liability for personal injury, loss, or property damage during events, except where caused by willful misconduct or gross negligence.
- People & Media Network may photograph, record, or livestream events. By attending, the consumer consents to the use of their image/voice in promotional and educational materials, unless explicitly objecting in advance.
Article 22 – Intellectual Property
- All content on the Platform, including text, graphics, logos, images, audio, video, software, course materials, and overall design, is the intellectual property of People & Media B.V. or its licensors, protected by applicable copyright, trademark, and intellectual property laws.
- No part of the Platform or its content may be reproduced, distributed, modified, transmitted, reused, or otherwise used without prior written permission, except as permitted under these terms or applicable law.
- The People & Media name, logo, and related marks are trademarks of People & Media B.V. Unauthorized use is strictly prohibited.
- Where content is shared by third-party contributors, intellectual property rights remain with the respective rights holders unless otherwise agreed in writing.
Article 23 – User-Generated Content
- The Platform may allow consumers to submit content such as comments, reviews, or forum posts (“User Content”).
- By submitting User Content, the consumer grants People & Media Network a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, adapt, publish, translate, and display such content in connection with the Platform.
- The consumer warrants that they own or have the necessary rights to their User Content and that it does not infringe the rights of any third party.
- The consumer agrees not to submit content that is unlawful, defamatory, abusive, threatening, harassing, hateful, obscene, or that violates the rights of others.
- People & Media Network reserves the right to remove, edit, or refuse to publish any User Content at its sole discretion without prior notice.
- People & Media Network assumes no liability for User Content submitted by consumers.
- When interacting with other members through the Platform (including but not limited to member profiles, forums, direct messages, and group discussions), the consumer agrees to: (a) treat other members with respect and courtesy, (b) refrain from soliciting, spamming, or engaging in unauthorized commercial activity, (c) not share other members’ personal information without their consent, and (d) report any abusive or inappropriate behavior to People & Media Network.
- People & Media Network is not responsible for interactions between members and does not mediate personal disputes. However, People & Media Network reserves the right to take action, including suspension or termination of accounts, in cases of harassment, abuse, or violation of these community conduct standards.
Article 24 – Limitation of Liability
- People & Media Network shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill.
- Total aggregate liability shall not exceed the amount paid by the consumer in the twelve (12) months preceding the event giving rise to the claim.
- Nothing in these terms shall exclude or limit liability for: (a) death or personal injury caused by negligence, (b) fraud or fraudulent misrepresentation, or (c) any liability that cannot be excluded under Dutch law.
- People & Media Network is not liable for the content, accuracy, or availability of third-party websites or services linked from the Platform.
- The Platform may offer interactive tools, calculators, or similar utilities (such as financial calculators) for informational and educational purposes only. These tools do not constitute professional, financial, medical, legal, or other specialized advice. People & Media Network makes no warranty as to the accuracy, completeness, or suitability of the results produced by such tools. The consumer is solely responsible for any decisions made based on the use of these tools and should seek qualified professional advice where appropriate.
Article 25 – Force Majeure
- People & Media Network shall not be liable for any failure or delay in performing its obligations where such failure results from circumstances beyond its reasonable control (“Force Majeure”).
- Force Majeure includes: natural disasters, pandemics, war, terrorism, civil unrest, government restrictions, power failures, internet disruptions, cyberattacks, strikes, and third-party service provider failures.
- In the event of Force Majeure, People & Media Network will use reasonable efforts to notify the consumer and mitigate effects. If the event continues for more than 90 days, either party may terminate the agreement in writing.
- Upon termination under this article, prepaid amounts for undelivered services will be refunded, less a reasonable amount for services already rendered.
Article 26 – Electronic Communication and Newsletters
- By creating an account or subscribing to a newsletter, the consumer may receive electronic communications including service notifications, promotional materials, and newsletters.
- Marketing communications will only be sent with prior consent (opt-in), in compliance with applicable anti-spam legislation and the GDPR. Consent may be withdrawn at any time via the unsubscribe link or by contacting People & Media Network.
- Service-related communications (order confirmations, account notifications, subscription reminders) are necessary for performance of the agreement and are not subject to opt-in requirements.
- People & Media Network will clearly identify itself as the sender of all electronic communications.
Article 27 – Cookies and Tracking Technologies
- The Platform uses cookies and similar tracking technologies (pixels, scripts) to enhance the user experience, analyze usage, and serve relevant content.
- Before placing non-essential cookies (analytics, marketing), People & Media Network will obtain the consumer’s explicit consent through a cookie consent mechanism, in accordance with the GDPR and ePrivacy Directive.
- Essential cookies, strictly necessary for the functioning of the Platform, may be placed without consent.
- The consumer may manage cookie preferences at any time through the Platform’s cookie settings or browser settings. Disabling certain cookies may affect Platform functionality.
- Further details on cookies used, their purposes, and retention periods are set out in our Cookie Policy, available on the Platform.
Article 28 – General Provisions
- If any provision of these terms is found invalid or unenforceable, the remaining provisions remain in full force. The invalid provision shall be replaced by a valid one that most closely reflects the original intent.
- People & Media Network reserves the right to amend these terms. Amendments will be published on the Platform at least 30 days before they take effect. Continued use constitutes acceptance.
- Failure by People & Media Network to enforce a right or provision shall not constitute a waiver of that right or provision.
- These terms and conditions, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between the consumer and People & Media Network.
- The Dutch-language version of these terms and conditions prevails in the event of any inconsistency with translations.
